TERMS AND CONDITIONS OF TICKET SALE
Art for Every Child – 2026-2027 Henri Matisse Edition
1. Organiser and purpose
1.1. These Terms and Conditions of Sale (“Terms”) govern online purchases of entries in the game with mandatory purchase “Art for Every Child” (the “Game”), organised by the Fondation Art Explora, whose registered office is located at 9 place de la Madeleine, 75008 Paris, France (“Art Explora” or the “Organiser”).
1.2. ARTERA / Art.Private. acts as operational service provider in accordance with the terms agreed with Art Explora. Art Explora remains the legal Organiser, contracts directly with the payment service provider and receives proceeds from entries directly.
1.3. These Terms supplement the official Game Rules (the “Rules”), available on artforeverychild.com. The Rules prevail for participation conditions, the draw, eligibility and allocation of the Prize.
1.4. Purchasing a ticket constitutes prior acceptance of these Terms and the Rules.
2. Tickets and price
2.1. The unit price of an entry is twenty-five euros (€25).
2.2. Each validated entry receives an individual number for the draw.
2.3. An entry is neither a financial instrument, nor title to the Prize, nor a promise of winning.
2.4. The maximum number of entries issued is set at two hundred thousand (200,000), corresponding to maximum total sales of five million euros (€5,000,000). The maximum number of entries and the participation period are those stated in the Rules. The period is scheduled to run from 21 October 2026 to 20 April 2027.
3. Purchase conditions and international participation
3.1. Purchases are limited to natural persons aged 18 or over with full legal capacity.
3.2. The Game is organised in France, is accessible through its official website and the draw takes place in France. Persons residing in France or abroad may participate, subject to the provisions applicable in their country of residence.
3.3. Any person residing outside France must, before purchasing, check that participation is not prohibited by mandatory rules applicable in his/her country or territory of residence. To the fullest extent permitted by law, Art Explora is not responsible for failure to comply with such local rules.
3.4. Art Explora may refuse an order or invalidate a participation for legal or regulatory reasons, sanctions, compliance or anti-money-laundering requirements, payment restrictions, fraud prevention or Prize-delivery constraints.
4. Ordering process
4.1. Purchases are made exclusively online through the official website.
4.2. Before payment, the purchaser selects tickets, provides requested information, checks the order and accepts the Terms and Rules.
4.3. Information must be accurate, complete and current.
4.4. An order is final only once payment has been effectively validated.
5. “Make a gift” option
5.1. A purchaser may buy an entry for themselves or select “Make a gift” to allocate it to another person.
5.2. For a gifted entry, the purchaser provides the Beneficiary’s first and last name, email address and any other requested information. The Beneficiary is recorded as the holder of the entry.
5.3. If a gifted entry is drawn, the Beneficiary – not the purchaser – is the person who may be declared the winner, subject to eligibility checks.
5.4. The Beneficiary must be 18 or over, have full legal capacity and satisfy the Rules.
5.5. The purchaser warrants the accuracy of Beneficiary information and must inform the Beneficiary of the purchase, Rules and data processing.
6. Payment, security and compliance checks
6.1. Payment is made using the methods offered online and processed by a secure provider contracted directly by Art Explora.
6.2. Proceeds from entries are received directly by Art Explora. ARTERA / Art.Private. does not receive sales proceeds for its own account.
6.3. An order may be rejected for payment failure, suspected fraud, compliance or anti-money-laundering requirements or restrictions imposed by the payment provider.
6.4. Art Explora may request further evidence, including identity or source-of-funds information. Enhanced checks may be triggered above a threshold or risk indicator set before launch.
6.5. Currency-conversion or card-issuer fees remain the purchaser’s responsibility.
7. Confirmation and ticket issuance
7.1. Following payment validation, an electronic confirmation is sent to the purchaser.
7.2. Entries are issued electronically and each number is the reference for participation in the draw. The Rules have been filed with SELARL ACTAY, associate commissaire de justice, 5 cité de Phalsbourg, 75011 Paris, France.
7.3. For a gifted ticket, the confirmation identifies the Beneficiary and a separate notice may be sent to him/her.
7.4. Apparent errors should be reported promptly.
8. Withdrawal and firm nature of the purchase
8.1. A validated entry purchase is firm and final and does not carry a withdrawal right where applicable law so permits.
8.2. No refund is due merely because the purchaser or Beneficiary no longer wishes to participate or is not selected.
8.3. A refund will only be made where mandatory law requires it or in the event of a duly established payment error requiring correction by Art Explora or its payment service provider.
8.4. Fraudulent orders or orders made in circumvention of restrictions may be refused or the corresponding participation may be invalidated.
9. Extension of the sales period
9.1. Any change to the participation period provided for in the Rules, including any extension, must be approved by Art Explora, its legal counsel and the commissaire de justice, and comply with the applicable formalities.
9.2. Any approved change will be announced on the website before it takes effect and, where appropriate, communicated to existing participants by email or another suitable means.
9.3. The draw is organised in accordance with the Rules, after the actual close of the participation period, subject to applicable mandatory provisions.
10. Website and technical incidents
10.1. Art Explora and its providers use reasonable means to maintain availability and security without guaranteeing uninterrupted operation.
10.2. The Organiser is not responsible for incidents arising from user equipment, internet access, telecommunications, the payment provider or events reasonably beyond its control.
10.3. Technical logs and payment data may be used to establish the existence of an order or an entry.
11. Personal data
11.1. Data are processed for payment, issuance of entries, the draw, compliance checks, participant support, winner verification and, where applicable, delivery of the Prize.
11.2. For a gifted entry, the Beneficiary’s data are collected to identify them as the holder of the entry.
11.3. Full information is set out in the website privacy policy.
11.4. Any Art.Private. marketing use is separate and subject to a distinct choice where consent is required.
12. Prize and winner
12.1. The value of the Prize is set at one hundred thousand euros (€100,000). The characteristics of the Prize, the draw, winner verification and delivery arrangements are governed by the Rules.
12.2. Transport, post-delivery insurance, customs, import and tax costs are allocated as set out in the Rules.
12.3. Purchasing an entry does not entail any guarantee as to the future value or resale price of the Prize.
13. Intellectual property
13.1. The website, “Art for Every Child” mark, content, photography, video, text and logos remain protected by their respective rights.
13.2. Purchasing a ticket grants no exploitation rights over those elements, the artwork image or the artist’s name.

16.2. The parties will first seek an amicable resolution; failing that, competent courts are determined under applicable rules.
